Rezoning Frequently Asked Questions
Scott Street Rezone
Q: What is a zoning district?
A: Zoning districts regulate what uses are permitted in a particular area. They also regulate the form of development including setbacks, maximum heights, and landscaping. Zoning districts vary across town. For example, some areas like the Development Park are suited for industrial uses whereas other areas of town like the South Hills are generally more suited for residential development. To find out what zoning district applies to your property, visit “What’s My Zoning?” and look up your address.
Q: What is a rezoning?
A: A rezoning changes the zoning district for a property or area. When a rezoning request is approved, the zoning map is amended to change the zoning district boundaries. Rezoning applications require a public hearing and must be approved by Planning Board and City Council. Zoning districts are applied based on the Growth Policy land use designation. The land use designation portrays the broader goals of the area and contains related zoning districts. A land owner can only request zoning districts that relate to the land use designation.
Q: What does Planning Board and City Council consider in their decision to approve or deny a rezoning request?
A: Rezoning applications may be approved by Planning Board and City Council only when they determine that the applicable review criteria in Title 20, Section 20.85.040.G have been satisfied. The review criteria are as follows:
- Whether the proposed zoning amendment is consistent with MCA § 76-2-304:
- Whether the zoning is made in accordance with a growth policy;
- Whether the zoning is designed to secure safety from fire and other dangers;
- Whether the zoning is designed to promote public health, public safety, and the general welfare;
- Whether the zoning is designed to facilitate the adequate provision of transportation, water, sewerage, schools, parks, and other public requirements;
- Whether the zoning considers the reasonable provision of adequate light and air;
- Whether the zoning considers the effect on motorized and nonmotorized transportation systems;
- Whether the zoning considers the promotion of compatible urban growth;
- Whether the zoning considers the character of the district and its peculiar suitability for particular uses; and
- Whether the zoning conserves the value of buildings and encourages the most appropriate use of land throughout the jurisdictional area.
- Whether the proposed zoning amendment corrects an error or inconsistency in the zoning ordinance or meets the challenge of a changing condition;
- Whether the proposed zoning amendment is in the best interests of the city as a whole.
Q: What does City Staff consider in making a recommendation for approval or denial of a rezoning request?
A: City Staff make a recommendation based on the findings of fact and conclusions of law in the staff report. Findings of fact are pulled from the rezoning application packet, documentation of access to infrastructure and services, the context of the surrounding neighborhood, as well as local, state, and federal regulations. The conclusions of law use the findings of fact to address whether the proposed rezoning meets the review criteria of Title 20, Section 20.85.040.G. If the conclusions of law state all of the applicable criteria have been satisfied, then City Staff recommend approval of the rezoning.
Q: Can City Council condition approval of a rezoning request?
A: Montana State Law prohibits conditioning the approval of a request to rezone from one standard zoning district in the City to another standard zoning district. City adopted standard zoning districts in the Title 20 Zoning Ordinance must have the same standards for all locations where that zoning occurs. All properties within the same zoning district must be treated equally and abide by the same regulations. Conditioning a rezoning would place more stringent requirements on one property owner than other property owners with land of the same zoning designation. Per State Law, City standard zoning districts must apply equally to all property with the same zoning designation.
Q: What is a protest petition for a rezoning?
A: State Law provides for property owners in close proximity to an area proposed for rezone to protest a rezoning. When a valid protest petition has been submitted, approval of a rezoning requires a two-thirds majority vote of those City Council members present and voting. In order to protest a rezoning, you must be a property owner of a parcel subject to the rezoning or a property owner of a parcel within 150 feet of the parcel to be rezoned. In order for the protest to be valid, the protest petition must be signed by 25% of the property owners specified above. The petition must be submitted to the zoning officer or on the public record before the City Council’s vote. We request the petition be sent to the case planner listed on the Engage Missoula page for a particular project. The case planner will ensure the petition is sent to the Zoning Officer and City Council. The petition must be submitted to allow sufficient time for the City Clerk to determine the validity of the petition. We ask that the petition be sent to the case planner at least one week prior to the City Council public hearing.
Q: What is the difference between M1R-2 and M1R-3 zoning designations?
A: Both M1-R-2 and M1R-3 are both Limited Industrial-Residential zones with the same allowed uses, building types, and site standards. The only difference between the two zoning designations is in the maximum allowable height; M1R-2 allows a maximum building height of 50 feet and the M1R-3 allows up to 65 feet.

PROJECT DESCRIPTION:
The City of Missoula Development Services has received a conditional use request for a for a Tavern and Casino use to be located at 3760 Mullan Road in Missoula. The conditional uses will be located on the southeast corner of the parcel within a new proposed commercial building which will also contain Restaurant and Food and Beverage Retail Sales uses.
The subject property is zoned Neighborhood Commercial (C1-3). According to Title 20, Section 20.10.020, both a Tavern and Casino use require conditional use approval to operate in the C1-3 zoning district. Title 20, Section 20.105.040 defines a Tavern use as, “an establishment that is primarily engaged in serving alcoholic liquor for consumption on the premises and in which the serving of prepared food and meals constitutes less than 65% of the establishment's gross income. Taverns and nightclubs may offer live entertainment and dancing,” and defines a Casino use as, “any establishment that offers legalized gambling authorized under MCA Title 23, Chapter 5, Part 1 et seq., and where any one of the following characteristics applies: a. The establishment is referenced as a ‘casino’ or ‘gambling establishment’, or makes any reference to legalized gambling by signage, advertisement or by name; b. Five or more gambling machines are on the premises; or c. A card table is on the premises.”
City Council is responsible for conducting a public hearing to either approve, conditionally approve, or deny this request.

PROJECT DESCRIPTION:
Community Planning, Development, and Innovation (CPDI) has received notice from WGM Group on behalf of Missoula County of their intent to provide amenities for temporary and emergency shelter on site through the Temporary Use, Emergency Homeless Shelter, and Group Living uses. The subject property is located at 2340 Mullan Road. The site will provide temporary safe outdoor space with prefabricated modular shelters, bathroom units and office space. This proposal is intended to address the housing crisis in a new way – aiding both individuals and the community.The proposal includes 30 short-term living units alongside one office building (Building A) and two restroom buildings (Buildings B & C) in the north-eastern corner of the subject parcel. A storage container will also be located on site. The proposal includes general-site landscaping nearly three-times in excess of what is required by Title 20. The existing trees and fence will remain on the north-eastern side of the site. A chain-link fence is proposed along all sides of the proposed development space, with a vehicular access point off West Broadway in the north-eastern corner of the site and a pedestrian connection and gate in the south-east corner of the site. The pedestrian connections on site consist of concrete and gravel.
The City Council is authorized to hold a public hearing when an agency proposes to develop or use public land contrary to these zoning regulations (Title 20, Chapter 20.85.095.A). City Council shall hold the public hearing as a public forum and shall have no power to deny or condition the proposed use but they shall act only to allow a public forum for comment on the proposed use (Title 20, Chapter 20.85.095.E). Missoula County is an agency and authorized to vary from the aforementioned zoning requirements by going through the public forum process.

PROJECT DESCRIPTION:
The City of Missoula Development Services has received a request from Steve Adler of Adler Architects, Inc, representing the owner of the property, Pighorn, Inc., addressed 502 S 4th St W, for an Administrative Adjustment to decrease the number of required spaces for the property from 5 to 4. Title 20, Section 20.85.110.B.8 authorizes the zoning officer, after consulting with the City Engineer, to approve an administrative adjustment to approve up to a 15% reduction in the number of off-street parking spaces required for nonresidential uses located within 500 feet of a transit stop that is served at intervals of 30 minutes or less between 7:00 am and 9:00 am and between 4:00 pm and 6:00 pm.
The subject property is zoned C1-4 (Neighborhood Commercial), which requires 2 off-street parking spaces per dwelling unit and 1 space for every 480 square feet of commercial (office) space. Since the property utilizes shared parking, the residential parking spaces may be reduced by up to 50%, so 2 spaces are required for the dwelling units. The commercial office space is 1241 square feet, so they would be required to provide 2.6 spaces. However, since they are located within 500 feet of a transit stop that is served at intervals of 30 minutes or less at peak times, they are eligible for up to a 15% reduction in the number of required spaces, which brings their required spaces to 2.

PROJECT DESCRIPTION:
Community Planning, Development, and Innovation has received notice from A&E Designs on behalf of Missoula County Fairgrounds of their intent to replace an existing sign with heritage signs at the Missoula County Fairgrounds. The subject property is located at 1075 South Avenue W. The proposed project includes the removal of the existing overhead entrance sign at Fair Way Drive and South Ave and the addition of two internally illuminated ground signs arching over the Fair Way Drive vehicle and pedestrian fairgrounds entrances. The new design will reflect the heritage of the Missoula County Fairgrounds using distinctive design and lighting, and a historically accurate arch and text font.
The large arched sign to be placed overhead of the vehicle entrance will be 46 square feet in area and 25 feet in height. The small arched sign to be placed overhead the pedestrian entrance is 11 square feet in area and 17 feet in height.
The proposed signs meet the definition of a heritage sign (Title 20, Chapter 20.100.010). A heritage sign is one that employs distinctive graphics, symbols and lighting that is a unique design to the community and are historically-accurate, reflecting the heritage of Missoula. Heritage signs maybe in the form of nonconforming signs or new signs that do not fit within the typical definition and measurements of wall, ground, or other sign.
Both signs were reviewed by the Historic Preservation Officer on March 14, 2022, and were found to comply with the Title 20 Heritage sign definition 20.100.010.
City Council is authorized by state law to hold a public hearing, known as a public forum, when a public agency proposes to use public land contrary to the local zoning regulations. The public agency in this case is Missoula County Fairgrounds. Title 20, Section 20.75.100.B.4 requires heritage signs to be approved by Design Review Board (DRB). However, Missoula County is an agency which allows them to vary from the requirement to establish heritage signs through DRB by holding a public forum at City Council. City Council does not have the power to deny or condition the approval of the project. The proposed use is permitted regardless of the outcome of the hearing. However, public comment is greatly appreciated.

PROJECT DESCRIPTION:
The City of Missoula Development Services has received a request from Mike Morgan of Hoffmann-Morgan Associates, representing the owner of the property addressed 1900 Strand Ave, for an Administrative Adjustment to increase the number of dwelling units allowed from twelve to thirteen units. Title 20, Section 20.85.110.B.7 authorizes the zoning officer to approve an administrative adjustment to permit the construction of one additional residential dwelling unit on a parcel that would otherwise be prohibited solely because the parcel does not comply with the minimum parcel area standards of the subject zoning district. A request can be made for an adjustment only if the existing parcel area is at least 95% of the required minimum area.
The subject property is zoned RM1-45 (Residential Multi-Dwelling), which requires 1,000 square feet of parcel area per dwelling unit. The property is 12,685 square feet or 97.58% of the required 13,000 square feet needed for 13 dwelling units.
The subject property is located in the Franklin to the Fort Neighborhood Council.

PROJECT DESCRIPTION:
The subdivider is preparing to file the final plat and create the lots for Phase 2 and 3 of the Remington Flats Subdivision approved by City Council on October 19, 2020. Remington Flats Subdivision is located east of Chuck Wagon Drive just north of 44 Ranch Subdivision in the Captain John Mullan Neighborhood Council area. State Law requires City Council to hold a public hearing before each phase of a subdivision proceeds to filing a final plat. City Council will review any changes in regulation or whether there is new information that may create significant adverse impacts for each phase that differs from what City Council considered at preliminary plat approval for the subdivision. Phase 2 and 3 are the second and third phases proceeding to final plat filing. The final plat for Phase 1 of Remington Flats Subdivision has been submitted for City staff review following City Council Phased Development Review approval on January 25, 2021.

Heron’s Landing Subdivision is located north of Mullan Road along both sides of George Elmer Drive in the Captain John Mullan Neighborhood Council area. State Law requires City Council to hold a public hearing before each phase of a subdivision proceeds to filing a final plat. City Council will review any changes in regulation or whether there is new information that may create significant adverse impacts for each phase that differs from what City Council considered at preliminary plat approval for the subdivision. PROJECT DESCRIPTION:
The City of Missoula Development Services has received a request from Mike Morgan of Hoffmann-Morgan Associates, representing the owner of the property addressed 3705 and 3715 England Boulevard, for an Administrative Adjustment to increase the number of dwelling units allowed from seventy-five (75) to seventy-six (76) units. Title 20, Section 20.85.110.B.7 authorizes the zoning officer to approve an administrative adjustment to permit the construction of one (1) additional residential dwelling unit on a parcel that would otherwise be prohibited solely because the parcel does not comply with the minimum parcel area standards of the subject zoning district. A request can be made for an adjustment only if the existing parcel area is at least 95% of the required minimum area.
The subject property is zoned B2-2 (Community Business), which requires 1,000 square feet of parcel area per dwelling unit. The property is 75,359 square feet or 99.2% of the required 76,000 square feet needed for seventy-six (76) dwelling units.
This is an administrative action which does not require a public hearing. However, property owners within 150 feet of the subject property are notified and provided the opportunity to submit public comment. Staff will issue a report on compliance with the review criteria of Title 20, Section 20.85.110.F. The Zoning Officer may either approve, approve with conditions, deny, or refer the request to Board of Adjustment for a decision.
The subject property is located in the Captain John Mullan Neighborhood Council.
