PROJECT DESCRIPTION:
An application is under review for rezoning of property located at 715 & 725 W. Central Ave. The property is located on the block west of Washington Middle School and across the street from Southside Lions Park. The request is to rezone two parcels from RM1-35 Residential (multi-dwelling) to B2-2 Community Business. City Council will either approve or deny the rezoning request. The requested zoning district is a standard zoning districts that applies equally to other areas of the city with the same zoning. City Council cannot subject the rezoning approval to conditions because State Law prohibits conditions to standard zoning districts.
Currently zoned RM1-35, the buildings occupying the subject parcels are operating as legal non-conforming multi-tenant commercial businesses. The rezone request of B2-2 aligns with Our Missoula Growth Policy and community business is supported by the Midtown Master Plan. Title 20 Table 20.10-1 outlines uses allowed in Business Districts.
The B2-2 Community Business zoning district has no minimum parcel area, except a minimum 3,000 square feet parcel area is required for single-purpose residential and mixed-use buildings. The minimum parcel area per dwelling unit is 1,000 square feet and there is no minimum parcel area per unit for vertical mixed-use buildings. The setbacks and building height of the B2-2 zoning district are as follows:
Setbacks:
Front - (North) - Front setbacks are required only when a Business or Commercially zoned parcel abuts a Residentially zoned parcel with frontage on the same street. In such cases, the B- or C-zoned parcel must match the actual front setback of the building that exists on the abutting R-zoned parcel, but no greater than the required setback for the abutting R-zoned parcel. In this case, a 20-foot front setback may be required unless the abutting structures are set back less than 20 feet from the front property line.
Side – 5 ft. Applicable to the east and west property lines since they will abut residential zoning.
Rear - (Alley) – None
Max Height: 50 ft., however for parcels abutting R districts that have a maximum allowed building height of 35 feet or less, this is the maximum building height at the point of the required minimum setback line is 35 feet. Height may be increased above 35 feet by up to one foot (vertical) for each 6 inches of building setback or upper floor step-back.

The subject property is split zoned RT2.7 Residential (two-unit/townhouse) and C1-4 Neighborhood Commercial. Title 20 states for existing and proposed uses and structures, the more restrictive provisions of the applicable zoning districts apply to the entire parcel. In this case, RT2.7 zoning applies to entire parcel.
The RT2.7 Residential (two-unit/townhouse) zoning district requires a minimum parcel area of 3,000 square feet, and a minimum parcel area per unit of 2,700 square feet. The required setbacks are 20 feet in the front and rear, 5 feet on interior sides, and 10 feet for street sides. The maximum height is 30 or 35 feet, depending on roof pitch. The permitted residential building types are detached house, lot line house, two-unit townhouse, two-unit house, and mixed-use building.
The C1-3 Neighborhood Commercial zoning district requires a minimum parcel area of 3,000 square feet for single-purpose residential and mixed-use buildings and no minimum parcel area for all other building types. The minimum parcel area per unit is 1,000 square feet for single-purpose residential and mixed-use buildings and no minimum parcel area per unit for Vertical Mixed-use buildings. There are no required front, rear, interior side, or street side setbacks required, except when the parcel is abutting an R district. The maximum height permitted is 65 feet. The C1-3 zoning district permits all residential and commercial building types. The C1 zoning district permits various civic, commercial, and industrial uses.
The rezoning would increase the density from one dwelling unit per 2,700 square feet of parcel area to one dwelling unit per 1,000 square feet of parcel area. With the current RT2.7 zoning, the zoning parcel would allow 5 dwelling units. Under the proposed C1-3 zoning, the zoning parcel would allow 14 dwelling units. The maximum permitted height would increase to 65 feet. The current maximum height is 35 feet.
Zoning is applied based on the land use designation of the Our Missoula 2035 City Growth Policy. Each land use designation has specific zoning districts that relate to the designation. This parcel has a split designation of Regional Commercial and Services and Residential Medium-High. In order to rezone the full parcel to C1-3, a targeted growth policy amendment is required to extend the Regional Commercial and Services land use designation to the east property line.

PROJECT DESCRIPTION:
City of Missoula Community Planning, Development, and Innovation has received a notice from Missoula County Public Schools of their intent to install dynamic reader board signs at Russell Elementary and Lewis and Clark Elementary. Russell Elementary School is located at 3216 South Russell Street. Lewis and Clark Elementary School is located at 2901 Park Street. The signs will be approximately 25 square feet in area and 15 feet off the ground. The signs will be installed on the building frontages facing Russell Street (Russell Elementary) and Queen Street (Lewis and Clark Elementary). The reader boards will be primarily used for messaging families and public on events and important dates happening at the school. The display could change daily and will be programmed to turn off between the hours of 10pm and 6am.
These signs will not be meeting the dynamic display and wall sign zoning requirements. The proposed signs will be larger than the maximum allowed area and height for wall signs in R5.4 Residential and OP3 Public Lands and Institutional zoning districts (Title 20, Chapter 20.75.050). The maximum area allowed is 12 square feet and the maximum height is 6 feet. The proposed dynamic display signs are permitted only in B1, B2, B3, C1, C2, M1, and M2 zoning districts (Title 20, Chapter 20.75.070.F.1). These signs will be in R5.4 and OP3 zoning districts. The dynamic display portion of the sign may not exceed 40 square feet or 50% of the total area of the sign, whichever is less, and must be computed as part of the sign’s total area (Title 20, Chapter 20.75.050.F2). The displays will exceed 50% of the total sign. The dynamic display sign face must be oriented away from adjacent residential uses and zoning districts (Title 20, Chapter 20.75.070.F.3) The proposed signs will face adjacent zoning districts.
City Council is authorized by state law to hold a public hearing, known as a public forum, when a public agency proposes to use public land contrary to the local zoning regulations. The public agency in this case is Missoula County Public Schools (MCPS). City Council does not have the power to deny or condition the approval of the project. The proposed use is permitted regardless of the outcome of the hearing. However, public comment is greatly appreciated and may be considered by MCPS.

PROJECT DESCRIPTION:
Community Planning, Development, and Innovation received an application for a public forum to vary from zoning code from the City of Missoula for the parcel at 1919 North Ave. West. The proposal is for the operation of temporary year-round Emergency Homeless Shelter by the Poverello Center in the building where the Emergency Weather Shelter previously operated. Zoning code regulates Emergency Homeless Shelters differently from Emergency Weather Shelters.
The City is deviating from two sections of Title 20, 20.40.045, section A.3 and section C.1, recognizing that this is a similar use that has operated with success for the last three years. These sections of code will not be met because the site is within 300 feet of a residential district and storage lockers will not be provided. The Poverello Center has an operational plan in place that addresses the lack of required storage lockers.
Furthermore, the proposed accessory structures, containing showers and bathrooms, will deviate from Title 20, Section 20.45.030.C because they are within 10 feet of each other. The City is also deviating from street frontage landscaping standards in Section 20.65.030, as two trees will be removed for a new sewer connection. No new landscaping is proposed.
The City Council is authorized to hold a public hearing when an agency proposes to develop public land contrary to local zoning regulations. The public agency in this case is the City of Missoula, which owns the subject property. City Council shall hold the public hearing as a public forum and shall have no power to deny or condition the proposed use, but shall act only to allow a public forum for comment on the proposed use. (See Title 20, Section 20.85.095.E)

Development Services has received a request from Todd Naylor with Telephone Data Systems (TDS) Metrocom, LLC for variances to front setback, side setback, and rear setback requirements for properties located at 1527 39th Street, 1885 Mount Avenue, 2220 River Road, and 3718 Rattlesnake Drive. Setback requirements in residential zones are listed in Title 20, Table 20.05-3. The applicant is requesting these variances as part of a proposal to install fiber-optic node cabinets for a broadband network. PROJECT DESCRIPTION:
Community Planning, Development, and Innovation received an application from Paradigm Architecture on behalf of the YMCA and Missoula County for the parcel at 3000 Russell St.
The proposed project includes the renovation of the existing YMCA facility and the addition of an Airnasium, childcare facility, and five new signs. There are several variations from local zoning regulations across the site and structures.
A Day Care Center of thirteen children or more is not a permitted use in OP3. There is currently a day care with the same use on the existing site. That building will be demolished, and a new childcare facility will be constructed.
The required number of vehicle parking spaces for the proposed new structures and uses is not met on site but is fulfilled by an adjacent lot to the south, leased from the City of Missoula by the YMCA. The site will also not meet short or long-term bicycle parking requirements.
General landscaping, street frontage landscaping, interior parking lot landscaping, and perimeter parking lot landscaping requirements will not be met. The number of trees and shrubs required for general landscaping will not be provided. The number of shrubs required for street frontage landscaping will not be provided. The parking lot will be mostly unchanged and the existing parking lot islands are not landscaped with trees or groundcover. There are not as many existing parking lot islands as are required. The new islands in the parking lot addition for the childcare facility will have trees but not groundcover. Perimeter parking lot landscaping standards will not be met through a berm, wall, or plantings. The ground-mounted mechanical equipment on site will not be screened from view of the street or park.
There will be six signs in total, five wall signs and one window sign. There is proposed to be two wall signs on the existing YMCA building, when only one is allowed per building. Both signs will be larger and taller than is permitted. There is also proposed to be a window sign on the second floor of the existing building, which is not permitted. There is proposed to be two wall signs on the new childcare facility. Both signs will be larger than the maximum area permitted and taller than the maximum height permitted. There is proposed to be a wall sign on the new Airnasium to be larger and taller than permitted.

PROJECT DESCRIPTION:
Development Services has received a request from Nicole Olmstead with Cushing Terrell on behalf of Hillview Road LLC, for a variance from the height requirements of the RM1-35 Residential (multi-dwelling) zoning district. The applicant makes this variance request as part of a proposal to construct five (5) new three-story multi-dwelling buildings. The height variance request is specific to three of the five buildings (A, B, and C) as indicated in the application packet.

PROJECT DESCRIPTION:
Community Planning, Development, and Innovation has received notice from A&E Designs on behalf of Missoula County Fairgrounds of their intent to replace an existing sign with heritage signs at the Missoula County Fairgrounds. The subject property is located at 1075 South Avenue W. The proposed project includes the removal of the existing overhead entrance sign at Fair Way Drive and South Ave and the addition of two internally illuminated ground signs arching over the Fair Way Drive vehicle and pedestrian fairgrounds entrances. The new design will reflect the heritage of the Missoula County Fairgrounds using distinctive design and lighting, and a historically accurate arch and text font.
The large arched sign to be placed overhead of the vehicle entrance will be 46 square feet in area and 25 feet in height. The small arched sign to be placed overhead the pedestrian entrance is 11 square feet in area and 17 feet in height.
The proposed signs meet the definition of a heritage sign (Title 20, Chapter 20.100.010). A heritage sign is one that employs distinctive graphics, symbols and lighting that is a unique design to the community and are historically-accurate, reflecting the heritage of Missoula. Heritage signs maybe in the form of nonconforming signs or new signs that do not fit within the typical definition and measurements of wall, ground, or other sign.
Both signs were reviewed by the Historic Preservation Officer on March 14, 2022, and were found to comply with the Title 20 Heritage sign definition 20.100.010.
City Council is authorized by state law to hold a public hearing, known as a public forum, when a public agency proposes to use public land contrary to the local zoning regulations. The public agency in this case is Missoula County Fairgrounds. Title 20, Section 20.75.100.B.4 requires heritage signs to be approved by Design Review Board (DRB). However, Missoula County is an agency which allows them to vary from the requirement to establish heritage signs through DRB by holding a public forum at City Council. City Council does not have the power to deny or condition the approval of the project. The proposed use is permitted regardless of the outcome of the hearing. However, public comment is greatly appreciated.

PROJECT DESCRIPTION:
Missoula County has requested a public forum regarding an exemption from the setback requirements of the OP3 Public Lands and Institutional zoning district for the Missoula County Fairgrounds located at 1101 South Ave West. The proposal includes the construction of a new building that will house the Rocky Mountain Garden and Exploration Center. The building is proposed to be setback 6 feet from the South Ave West property line. Normally, the required front setback in the OP3 zoning district is 30 feet.
The City of Missoula Board of Adjustment is authorized by state law to hold a public hearing, known as a public forum, when a public agency proposes to use public land contrary to the local zoning regulations. In this case, Missoula County is the public agency proposing to use public land contrary to the zoning regulations by varying from the front setback. The Board of Adjustment does not have the power to deny or condition the approval of the project. The proposed use is permitted regardless of the outcome of the hearing. We invite you to submit public comment stating your opinion on the proposal.
