Public bodies like the Missoula City Council, Missoula City-County Consolidated Planning Board, City Board of Adjustment, and City Design Review Board encourage public comment as a way to better understand aspects of the development project, potential impacts, and ways the impacts might be mitigated.

    PROJECT DESCRIPTION:

    Community Planning, Development, and Innovation has received notice from A&E Designs on behalf of Missoula County Fairgrounds of their intent to replace an existing sign with heritage signs at the Missoula County Fairgrounds. The subject property is located at 1075 South Avenue W. The proposed project includes the removal of the existing overhead entrance sign at Fair Way Drive and South Ave and the addition of two internally illuminated ground signs arching over the Fair Way Drive vehicle and pedestrian fairgrounds entrances. The new design will reflect the heritage of the Missoula County Fairgrounds using distinctive design and lighting, and a historically accurate arch and text font.

    The large arched sign to be placed overhead of the vehicle entrance will be 46 square feet in area and 25 feet in height. The small arched sign to be placed overhead the pedestrian entrance is 11 square feet in area and 17 feet in height.

    The proposed signs meet the definition of a heritage sign (Title 20, Chapter 20.100.010). A heritage sign is one that employs distinctive graphics, symbols and lighting that is a unique design to the community and are historically-accurate, reflecting the heritage of Missoula. Heritage signs maybe in the form of nonconforming signs or new signs that do not fit within the typical definition and measurements of wall, ground, or other sign.

    Both signs were reviewed by the Historic Preservation Officer on March 14, 2022, and were found to comply with the Title 20 Heritage sign definition 20.100.010.

    City Council is authorized by state law to hold a public hearing, known as a public forum, when a public agency proposes to use public land contrary to the local zoning regulations. The public agency in this case is Missoula County Fairgrounds. Title 20, Section 20.75.100.B.4 requires heritage signs to be approved by Design Review Board (DRB). However, Missoula County is an agency which allows them to vary from the requirement to establish heritage signs through DRB by holding a public forum at City Council. City Council does not have the power to deny or condition the approval of the project. The proposed use is permitted regardless of the outcome of the hearing. However, public comment is greatly appreciated.

    PROJECT DESCRIPTION:

    Missoula City Fire Department requested a public forum regarding an exemption from allowed uses in the R5.4 Residential zoning district and the general site landscaping standards at Fire Station #3 located at 1501 39th Street. The proposal includes the construction of a new 3,200 square foot storage building on the western side of the property. Fire Stations are classified in Title 20 as safety services.

    The requested exemption is from Title 20, Table 20.05-1 which does not list safety services as a permitted use in the R5.4 Residential zoning district. Construction of the new storage building is considered an expansion of the legal non-conforming use.

    In order to construct the storage building, two (2) on-site trees will be removed. Removal of the trees may bring the parcel out of compliance with Title 20, Section 20.65.020.B.3 which requires six (6) trees on the parcel. Based on aerial imagery, there appears to be at total of eight (8) trees located on the parcel. Following the removal of two (2) trees, six (6) trees would remain which meet would Title 20 requirements. However, these trees may be located within the right-of-way. If the trees are located within the right-of-way they will not count towards the general site landscaping requirements and the landscaping will no longer comply with zoning. There has not been a site survey to confirm the locations of the trees in relation to the property line.

    The City of Missoula Board of Adjustment is authorized by state law to hold a public hearing, known as a public forum, when a public agency proposes to use public land contrary to the local zoning regulations. The public agency in this case is the City Fire Department. The Board of Adjustment does not have the power to deny or condition the approval of the project. The proposed use is permitted regardless of the outcome of the hearing. However, public comment is greatly appreciated.

    Missoula County has requested a public forum regarding an exemption from the setback requirements of the OP3 Public Lands and Institutional zoning district for the Missoula County Fairgrounds located at 1101 South Ave West. The proposal includes the construction of a new building that will house the Rocky Mountain Garden and Exploration Center. The building is proposed to be setback 6 feet from the South Ave West property line. Normally, the required front setback in the OP3 zoning district is 30 feet.

    The City of Missoula Board of Adjustment is authorized by state law to hold a public hearing, known as a public forum, when a public agency proposes to use public land contrary to the local zoning regulations. In this case, Missoula County is the public agency proposing to use public land contrary to the zoning regulations by varying from the front setback. The Board of Adjustment does not have the power to deny or condition the approval of the project. The proposed use is permitted regardless of the outcome of the hearing.     DeSmet School, located at 6355 Padre Lane, has requested a public forum for an exemption from the zoning requirements regarding dynamic display signs. DeSmet School District is proposing to install a dynamic display ground sign. The proposed dynamic display is not permitted in this zoning district and will exceed the permitted dynamic display area relative to the area of the proposed sign.

    Missoula County has requested a public forum for an exemption from the zoning requirements of the Design Excellence Overlay at 140 N. Russell Street. The exemptions pertain to build-to-width requirements, parking lot setback and placement, and landscaping design. The proposal includes the modification of an existing parking lot and the addition of new parking on the property. The site contains two existing buildings that house the Missoula County Elections Center.

    The City of Missoula Parks and Recreation has requested a public forum regarding an exemption to zoning setbacks for new bathroom enclosures at Rose Park and Westside Park. The new bathroom enclosures will be placed within the 20 foot front setback of each park, near the street. The City of Missoula Board of Adjustment is authorized to hold a public hearing when an agency proposes to develop or use public land contrary to the zoning regulations. The Board of Adjustment shall have no power to deny or condition the proposed development. Public comment on this project is appreciated.
