Parkland Dedication Amendment
Consultation has concluded.
The Missoula City Council approved an amendment to Article 3, Section 080.7 of the City of Missoula’s subdivision regulations on May 10, 2021.
The amendment does two things: 1) resolves ambiguities existing in the previous language, and 2) provides clarity and clear direction related to the acceptable methodologies for demonstrating fair market value.

Section 3-080.7 encompasses the “cash-in-lieu of parkland dedication” requirement. Background and contextual information related to Section 3-080.7 (e.g., underlying intent and policy and how the requirements fit into the subdivision process) is included in the attached “C-i-L Sub. Reg. Amendment Background and Context.”
The amendment does two things: 1) resolve ambiguities existing in the current language, and 2) provide clarity and clear direction related to the acceptable methodologies for demonstrating fair market value. The development community has made it clear that it desires the cash-in-lieu of parkland dedication process to be predictable, expedient, and clear. The proposed amendment heavily weighs those three basic tenets, and the Parks Department intends for the results of the amendment to be mutually beneficial.
