    PROJECT DESCRIPTION:

    Development Services has received a conditional use request from David Gray from DVG Architecture and Planning on behalf of the Westside Theater to add tavern use to the existing Westside Theater located at 1200 Shakespeare Street Suite 2. The tavern conditional use will be located in Suite 2 in addition to the existing use of Entertainment and Spectator Sports - Small Venue for Westside Theater. Existing uses on the subject property include Business Equipment Sales and Service, Building Maintenance Service, Car Wash/Cleaning Service, and Sports & Recreation – Participant.

    The subject property is zoned Limited Industrial-Residential (M1R-2). According to Title 20, Section 20.15.020, a Tavern use requires conditional use approval to operate in the M1R-2 zoning district. Title 20, Section 20.105.040 defines a Tavern use as, “an establishment that is primarily engaged in serving alcoholic liquor for consumption on the premises and in which the serving of prepared food and meals constitutes less than 65% of the establishment's gross income. Taverns and nightclubs may offer live entertainment and dancing.”

    Westside Theater intends to sell alcoholic beverages at events. City Council will either approve, approve with conditions, or deny the conditional use request.

    Westside Theater is in City Council Ward 2 and the Westside Neighborhood Council.

    PROJECT DESCRIPTION:

    An application is under review for a Conditional Use request for a Townhome Exemption Development (TED) at the unaddressed property located southeast of Hellgate Elementary, east of Flynn Lane, immediately adjacent to the West of Mary Jane Boulevard. The subject parcel is currently vacant.

    This proposal includes a 33-unit residential development and is the second of two planned developments bordering Mary Jane Boulevard: Hellgate Village East, approved as a TED Conditional Use in 2021, and Hellgate Village West, the TED Conditional Use currently requesting approval in 2023. The project proposes detached house and townhouse building types.

    The applicant began the planning process with Development Services under Ordinance #3609. This is not the current TED Ordinance. The City Attorney’s Office issued a letter stating that Ordinance #3609 will apply to this project. The subject property is zoned B2-1 Community Business. Per Title 20, Section 20.05.040 Figure 20.05-7 under Ordinance #3609, Townhome Exemption Developments of ten or more units in the B2-1 zoning district require conditional use approval in accordance with the provisions of Title 20, Section 20.85.070.

    Review criteria for conditional uses can be found in Section 20.85.070.H of the Missoula Title 20 Zoning Code.

    The subject property is in the Captain John Mullan Neighborhood, and City Council Ward 2. The current Land Use designation for this property is Neighborhood Mixed-Use.

    The City of Missoula Development Services has received a conditional use request for a for a Tavern and Casino use to be located at 3760 Mullan Road in Missoula. The conditional uses will be located on the southeast corner of the parcel within a new proposed commercial building which will also contain Restaurant and Food and Beverage Retail Sales uses.

    The subject property is zoned Neighborhood Commercial (C1-3). According to Title 20, Section 20.10.020, both a Tavern and Casino use require conditional use approval to operate in the C1-3 zoning district. Title 20, Section 20.105.040 defines a Tavern use as, “an establishment that is primarily engaged in serving alcoholic liquor for consumption on the premises and in which the serving of prepared food and meals constitutes less than 65% of the establishment's gross income. Taverns and nightclubs may offer live entertainment and dancing,” and defines a Casino use as, “any establishment that offers legalized gambling authorized under MCA Title 23, Chapter 5, Part 1 et seq., and where any one of the following characteristics applies: a. The establishment is referenced as a ‘casino’ or ‘gambling establishment’, or makes any reference to legalized gambling by signage, advertisement or by name; b. Five or more gambling machines are on the premises; or c. A card table is on the premises.”

    City Council is responsible for conducting a public hearing to either approve, conditionally approve, or deny this request.

    The City of Missoula Development Services has received a conditional use request for a Pet Emergency Center to be located at 1914 S Reserve Street and 2432 North Avenue W in Missoula. Pet Emergency Center, a professional veterinary services facility, would like to expand the existing use of professional veterinary services at 1914 S Reserve Street to the adjacent property located at 2432 North Avenue W. The new building will provide abundant space for the growing practice and will allow for new veterinary specialists and equipment. The new building was approved for compliance with Design Excellence. Exterior materials have been selected for durability and to help complement neighboring uses and building scales.

    The subject property is zoned Community Business (B2-2), and is within Design Excellence Overlay-Corridor Typology 4. According to Title 20, Section 20.10.020, a Veterinary Animal Service use requires conditional use approval to operate in the B2-2 zoning district. Title 20, Section 20.105.040 defines Animal Services-Veterinary as, “Typical uses include pet clinics, dog and cat hospitals and animal hospitals.”

    The City of Missoula Development Services has received a conditional use request for a Boarding Kennel to be located at 2100 S Reserve Street in Missoula. Unleashed, a dog daycare facility, would like to add boarding and kennel service to their current location. Unleashed is located in a small shopping center with an interior parking lot shielded from view of the adjoining residential neighborhood. The Kennel will serve a maximum of twenty (20) dogs at one time.

    The subject property is zoned C1-4 Neighborhood Commercial and is within Design Excellence Overlay-Corridor Typology 4. According to Title 20 Zoning Code an Animal Boarding Kennel use requires conditional use approval to operate in the C1-4 zoning district.     PROJECT DESCRIPTION:

    An application is under review for a group living conditional use at 246 S 6th St W, 234 S 6th St W, and 228 S 6th St W in Missoula. If approved, the proposed senior group living project will consist of one building with 36 sleeping units, comprised of 13 one-bedroom units and 23 studio units with shared kitchen, dining, and living spaces. The project’s intent is to create attainable, accessible housing for seniors. The facility will apply for an age restriction of 55+ under the Housing for Older Persons Act of 1995 (HOPA). City Council may vote to approve, approve with conditions, or deny the request for the casino and tavern uses.

    A conditional use application is under review for a forty-three (43) dwelling unit Townhome Exemption Development (TED). The subject property is located south of the Pleasant View Homes #3 Subdivision near Hellgate Elementary School. If approved, the applicant will create 43 townhome ownership units, each containing one dwelling unit. City Council may vote to approve, approve with conditions, or deny the conditional use request.

The two structures contain a combined forty-six (46) bedrooms with shared kitchen and gathering spaces; intended to provide rental space to separate tenants using shared facilities in the manner of a shared co-op. Zoning considers such living arrangements as ‘Group Living’, which requires a conditional use approval to operate in the zoning district the property is in.
